The Facts
 

·        At approximately 6:10pm of Friday June 26, 2009 two agents of Plaintiff (Black/African-American Female) arrive at the dwelling.

·          Upon arrival at the dwelling, agents of Plaintiff (Black/African-American Female)  discovered that the tenants (Non White/ Hispanics of Mexican Origin), and their family, had already arrived at the dwelling and were in a discussion with Defendant Debbie Labit Stricks, a code enforcement officer of Defendant St. John The Baptist Parish.

·         On Friday June 26, 2009 at approximately 6:15pm, within the boundaries of the dwelling and in the presence of two agents for Plaintiff (Black/African-American Female), Defendant Debbie Labit Stricks stated to the tenants (Non White/ Hispanics of Mexican Origin):

    • “I know you all are not drug dealers; you look like hard working peoples, but I just can’t let y’all live here. This neighborhood is for families and y’all ain’t no family.  Under our ordinances a family is made up of a father, mother and child.  Y’all ain’t no family and I can’t let y’all move in here.  We have gotten numerous complaints already. If y’all live here you will be in violation and R1-A and will be fined.”

 

·         Defendant Debbie Labit Stricks, orally cited local ordinance R1-A to the tenants, their family members, and agents for the Plaintiff (Black/African-American Female), proffered that it was illegal for the tenants (Non White/ Hispanics of Mexican Origin) to lease the dwelling from the Plaintiff (Black/African-American Female) and for the Plaintiff (Black/African-American Female) to lease the dwelling to the tenants.

·        Defendant Debbie Labit Stricks, while physically standing in the path of the Plaintiffs agents and the tenants (Non White/ Hispanics of Mexican Origin); barred entry into the dwelling and the subsequent transfer of custody and control of the Plaintiffs (Black/African-American Female) dwelling to the tenants (Non White/ Hispanics of Mexican Origin).   Defendant Stricks summoned or called local police to the scene.  At about 6:30pm on June 26, 2009, tenants, and their family members, along with agents of the Plaintiff (Black/African-American Female) departed from the dwelling without incident or interaction with local police.
